NATIONAL BOARD OF REVENUE (NBR)

The National Board of Revenue (NBR) is the central authority for tax administration in Bangladesh. It was established by President's Order No. 76 of 1972. Administratively, it is under the Internal Resources Division (IRD) of the Ministry of Finance (MoF). MoF has 4 Divisions, headed by 4 permanent Secretaries to the Government, namely, the Finance Division the Internal Resources Division (IRD), the Banking Division and the Economic Relations Division (ERD). The Secretary, IRD is the ex-officio Chairman of NBR. NBR is responsible for formulation and continuous re-appraisal of tax-policies and tax-laws, negotiating tax treaties with foreign governments and participating in inter-ministerial deliberations on economic issues having a bearing on fiscal policies and tax administration.

The main responsibility of NBR is to collect domestic revenue (primarily, Import Duties and Taxes, VAT and  Income Tax ) for the government.  Other responsibilities include administration of all matters related to taxes, duties and other tax producing fees. Under the overall control of IRD, NBR administers the Excise, VAT, Customs and Income-Tax services consisting of 3434 officers of various grades and 10195 supporting staff positions (Approved set up as on 09 Feb., 2000 AD).

Income Tax

Among direct taxes, income tax is one of the main sources of revenue. It is a progressive tax system. Income tax is imposed on the basis of ability to pay. The more a taxpayer earns the more he should pay''- is the basic principle of charging income tax. It aims at ensuring equity and social justice.

Sources of Income

For the purpose of computation of total income and charging tax thereon, sources of income can be classified into 7 categories, which are as follows :

1)  Salaries
2)  Interest on securities
3)  Income from house property
4)  Income from agriculture
5)  Income from business or profession
6)  Capital gains
7)  Income from other sources.

Tax Rebate for investment :

Rate of Rebate:
Amount of allowable investment is - actual investment or 20% of total income or Tk.        100,00,000/-whichever is less. Tax rebate amounts to 10% of allowable investment.
Types of investment qualified for the tax rebate are :-

* Life insurance premium up to 10% of the face value.
* Contribution to Provident Fund to which Provident Fund Act, 1925 applies.
* Self contribution and employer's contribution to Recognized Provident Fund.
* Contribution to Supper Annuation Fund.
* Contribution up to TK 60,000 to deposit pension scheme sponsored by any scheduled bank or a financial institution.
* Investment in approved debenture or debenture stock, Stocks or Shares
* Contribution to Benevolent Fund and Group Insurance premium
* Contribution to Zakat Fund
* Donation to charitable hospital approved by National Board of Revenue

* Donation to philanthropic or educational institution approved by the Government
* Donation to socioeconomic or cultural development institution established in Bangladesh by Aga Khan Development Network
* Donation to ICDDRB,
* Donation to philanthropic institution-CRP, Savar, Dhaka

Who should submit Income Tax Return?

  1. If total income of any individual other than female taxpayers, senior male taxpayers of 65 years and above and retarded taxpayers during the income year exceeds Tk 2,00,000/-.
  2. If total income of any female taxpayer, senior male taxpayer of 65 years and above during the income year exceeds Tk 2,25,000/-.
  3. If total income of any retarded taxpayer during the income year exceeds TK. 2,75,000.
  4. If any person was assessed for tax during any of the 3 years immediately preceding the income year.
  5. A person who lives in any city corporation/paurashava/divisional HQ/district HQ and owns a building of more than one storey and having plinth area exceeding 1,600 sq. feet/owns motor car/owns membership of a club registered under VAT Law.
  6. If any person subscribes a telephone.
  7. If any person runs a business or profession having trade license and operates a bank account.
  8. Any professional registered as a doctor, lawyer, income tax practitioner, Chartered Accountant, Cost & Management Accountant, Engineer, Architect and Surveyor etc.
  9. Member of a Chamber of Commerce and Industries or a trade Association.
  10.  Any person who participates in a tender.
  11. A person who has a Taxpayer's Identification Number (TIN) in accordance with the provision of section 184A.
  12. Candidate for Union Parishad, Paurashava, City Corporation or Parliament elections.
  13. Any company registered under the Company Act, 1913 or 1994.
  14. Any Non-government organization (NGO) registered with NGO Affairs Bureau.

 

Submission of withholding tax return

Person who makes any TDS (Tax Deducted at Source) on payment, must file a separate return of withholding tax.  To be submitted at
-15th day of October, January, April, July
-or extended date up to 15 days by DCT.

Major areas for final settlement of tax liability

Tax deducted at source for the following cases is treated as final discharge of tax liabilities. No additional tax is charged or refund is allowed in the following cases:-

  1. Supply or contract work or local LC (Sec-52);
  2. Royalty, fees for technical services (Sec 52A(2);
  3. Commission from clearing & forwarding (C & F) agency (Sec 52AAA);
  4. Band rolls of handmade cigarettes (Sec-52B);
  5. Compensation against acquisition of properties (Sec 52C);
  6. Rental power companies (52N)
  7. Salaries of foreign technician of Diamond cutting industry (Sec 52O)
  8. International gateway service (IGW) and Interconnection Exchange (ICX) in respect of international Phone calls (52R)
  9. Import of goods, not being goods imported by an industrial undertaking as raw materials for its own consumption (Sec 53);
  10. Shipping business of a resident (Sec 53AA)
  11. Export of manpower (Sec 53B)
  12. Export of certain items (such as knit & woven garments etc) {sec 53BB}
  13. Transaction by a member of a Stock Exchange (Sec 53BBB)
  14. Auction purchase (Sec 53C)
  15. Courier business of non-resident (53CC)
  16. Cash subsidy (52DDD)
  17. Real estate or land development business (Sec 53FF);
  18. Insurance agent commission (Sec 53G).
  19. Payment on account of survey by surveyor of a general insurance company (Sec 53GG);
  20. Transfer of property (Sec 53 H)
  21. Premium over face value of share (Sec-53L)
  22. Income from transfer of securities or mutual fund units by a sponsor share holder (Sec 53M)
  23. Winning of lotteries [Sec 19(13)] or Sec 55.

 

Tax Recovery System

In case of non-payment of income tax demand the following measures can be taken against a taxpayer for realization of tax:-

  • Imposition of penalty
  • Attachment of bank accounts, salary or any other payment.
  • Filing of Certificate case to the Special Magistrate.

 

Advance Payment of Tax

Every taxpayer is required to pay advance tax in four equal installments falling on-

  • 15th September
  • 15th December
  • 15th March and
  • 15th June

-of each year if the latest assessed income exceeds Taka 4(four) lac. Penalty is imposed for default in payment of any installment of advance tax.

 

Fiscal incentives

Following are fiscal incentives available to a taxpayer:-

  1. Tax holiday :
  2. Tax holiday is allowed for industrial undertaking and physical infrastructure facility established between 1st July 2011 to 30th June 2013 in fulfillment of certain conditions.
    Industrial Undertaking Eligible for Tax holiday :

    1. active pharmaceuticals ingredient industry and radio pharmaceuticals industry;
    2. barrier contraceptive and rubber latex;
    3. basic chemicals or dyes and chemicals;
    4. basic ingredients of electronic industry (e.g resistance, capacitor, transistor,       integrator circuit);
    5. bio-fertilizer; (will get tax holiday even it is set up in distict of Dhaka,      Narayanganj, Gazipur, Chittagong, introduced in FA 2012)
    6. biotechnology;
    7. boilers;
    8. compressors;
    9. computer hardware;
    10. energy efficient appliances;
    11. insecticide or pesticide;
    12. petro-chemicals;
    13. pharmaceuticals;
    14. processing of locally produced fruits and vegetables;
    15. radio-active (diffusion) application industry (e.g. developing quality or decaying   polymer or preservation of food or disinfecting medicinal equipment);
    16. textile machinery;
    17. tissue grafting; or
    18. any other category of industrial undertaking as the Government may, by notification in the official Gazette, specify. Physical Infrastructure Eligible for Tax holiday:
      1. deep sea port;
      2. elevated expressway;
      3. export processing zone;
      4. flyover;
      5. gas pipe line,
      6. Hi-tech park;
      7. Information and Communication Technology (ICT) village or software    technology zone;
      8. Information Technology (IT) park;
      9. large water treatment plant and supply through pipe line;
      10. Liquefied Natural Gas (LNG) terminal and transmission line;
      11. mono-rail;
      12. rapid transit;
      13. renewable energy (e.g energy saving bulb, solar energy plant, windmill);
      14. sea or river port;
      15. toll road or bridge;
      16. underground rail;
      17. waste treatment plant; or
      18. any other category of physical infrastructure facility as the Government may, by notification in the official Gazette, specify.

  3. Income derived from any Small and Medium Enterprise (SME) engaged in production     of any goods and having an annual turnover of not more than taka twenty four lakh is exempt from tax.
  4. Income from poultry is exempt from tax up to 30th June, 2013, subject to investing at least 10% of the exempted income in the purchase of bond or securities if such income exceeds Tk. 1,50,000/-.
  5. Income derived from export of handicrafts is exempted from tax up to 30th June, 2013.
  6. An amount equal to 50% of the income derived from export business is exempted from tax.
  7. Listed companies are entitled to 10% tax rebate if they declare dividend of more than20%.
  8. Income from Information Technology Enabled Services (ITES) business is exempted up to 30th June, 2013.
  9. Income of any private Agricultural College or private Agricultural University derived from agricultural educational activities. i) Income received as pension and gratuity.
  10. Income from dividend of a mutual fund or a unit fund up to taka 25000.
  11. Income from dividend amounting to Tk. 5000.

Avoidance of Double Taxation Agreement

There are agreements on avoidance of double taxation between Bangladesh and 29 countries which aree:-

Value Added Tax

  1. VAT is imposed on goods and services at import stage, manufacturing, wholesale and retails levels;
  2. A uniform VAT rate of 15 percent is applicable for both goods and services;
  3. 15 % VAT is applicable for all business or industrial units with an annual turnover of Taka  2 million and above;
  4. Turnover tax at the rate of 4% is leviable where annual turnover is less than Taka 2 million;
  5. VAT is applicable to all domestic products and services with some exemptions;
  6. VAT is payable at the time of supply of goods and services;
  7. Tax paid on inputs is creditable/adjustable against output tax;
  8. Export is exempt;
  9. Cottage industries (defined as a unit with an annual turnover of less than Taka 2 million and with a capital machinery valued up to Taka 3,00,000) are exempt from VAT;
  10. Tax returns are to be submitted on monthly or quarterly or half yearly basis as notified by the Government.
  11. Supplementary Duty (SD) is imposed at local and import stage under the VAT Act, 1991.

Existing statutory SD rates are as follows:
(a)  On goods: 20%, 35%, 65%, 100%, 250% & 350%
(b)  On services: 10%, 15% & 35%.

Truncated Base / Fixed Value Addition:

In some of the cases of goods and services producers and sellers face difficulties in availing VAT credit/adjustment facilities due to non availability of invoices from the sellers of input. In order to remove this operational difficulty fixed bases such as 10%, 25%, 30%, and 60% value addition is taken into account for calculation of VAT for a number of goods and services. In such circumstances net VAT rate for different rates of value addition comes to 1.5%, 2.25%, 4.5% and 9%.

VAT at the wholesale and retail stage: In case of wholesalers and retailers, there is a special provision for a 1.5% percent VAT known as Trade VAT on the total sale, provided that the wholesaler/retailer do not avail the facility of input credit/adjustment. Such tax is also collected at the import stage from importers of finished goods as an advance trade VAT.

Tariff Value for imposition of VAT: Under the VAT Law, the government is empowered to fix Tariff Value for some items for the collection of VAT. Example: tariff value for mild-steel products produced from imported/locally procured re-rollable scraps is TK 4000.00 per MT. Normal VAT input credit is also not available under this system.

Deduction of VAT at sourceAs deduction at source is also practiced in case of VAT on certain services, Government, Semi-Government, Autonomous Bodies, NGOs, Banks, Insurance Companies and Limited Companies are authorized by the government to deduct applicable VAT on the services at source.

Excise Duty: At present excise duty applies to only two items: bank deposits and domestic air ticket (Tk. 250 per journey).
Customs

Customs wing is primarily responsible for collection of all duties and taxes at the import stage. Apart from collection of government revenue it is also responsible for trade facilitation, enforcement of government regulations, protection of society and environmental protection, preparation of foreign trade statistics, trade compliance and protection of cultural heritage.

Customs collects 42% of the NBR’s total revenue. The revenue target for the year 2007-08 was Tk. 17,812 Cr. and actual revenue collection so far (July’ 07 to May’08) is Tk. 16, 987.06 Cr. that is 19.04% higher than the previous year. The target has been revised to Tk. 19385 Cr. for 2007-08 and with an increase of 16.25%; it has been set to Tk. 22,536 Cr. for the year 2008-09.

In the present financial year (2007-08) there are 3 duty slabs of customs duties i.e. 10% for basic raw material, 15% for intermediate raw material or semi finished products, and 25% for finished products. In the proposed 2008-09 budget, the duty structure has been restructured and a four tier duty structure has been proposed, i.e. 3% for capital machinery, 7% for basic raw material, 12% for intermediate raw-material or semi finished products, and 25% for finished products.

Since Customs functions at the gateway for import and export of goods, it plays a critical role in the import-export trade chain. In order to make customs procedures more transparent and to achieve more trade facilitation, a number of measures have been taken in past few years. With the introduction of ASYCUDA++ and Direct Traders Input (DTI) automation in customs clearance has begun. Recently, a full automation scheme is on way of implementation in collaboration with the Chittagong Chamber and the Task Force. Once the full automation is completed the importers and exporters will be able to access customs server from their offices or homes and will be able to submit their customs declaration online.

  2. Raw materials of Medicine;
  3. Poultry Medicine, Feed & machinery;
  4. Defence stores;
  5. Chemicals of leather and leather goods;
  6. Private power generation unit;
  7. Textile raw materials and machinery;
  8. Solar power equipment;
  9. Relief goods;
  10. Goods for blind and physically retarded people; and
  11. Import by Embassy and UN.

Instructions:

(1)   This return of income shall be signed and verified by the individual assessee or person as prescribed u/s 75 of the Income Tax Ordinance, 1984.
(2)     Enclose where applicable:

  1. Salary statement for salary income; Bank statement for interest; Certificate for interest on savings instruments; Rent agreement, receipts of municipal tax and land revenue, statement of house property loan interest, insurance premium for house property income; Statement of professional income as per IT Rule-8; Copy of assessment/ income statement and balance sheet for partnership income; Documents of capital gain; Dividend warrant for dividend income; Statement of other income; Documents in support of investments in savings certificates, LIP, DPS, Zakat, stock/share etc.
  2. Statement of income and expenditure; Manufacturing A/C, Trading and Profit & Loss A/C and Balance sheet;
  3. Depreciation chart claiming depreciation as per THIRD SCHEDULE of the Income Tax Ordinance, 1984;

(d)  Computation of income according to Income tax Law;

(3)     Enclose separate statement for:

  1. Any income of the spouse of the assessee (if she/he is not an assessee), minor children and dependant;
  2. Tax exempted / tax free income.

(4)   Fulfillment of the conditions laid down in rule-38 is mandatory for submission of a return under "Self Assessment".

(5)  Documents furnished to support the declaration should be signed by the assessee or his/her authorized representative.

(6)   The assesse shall submit his/her photograph with return after every five year.

(7)   Furnish the following information:

(9) Signature is mandatory for all the assessee or his/her authorized representative. For individual, signature is also mandatory in I.T-10B and I.T-10BB.
